The United States Trotting Association (USTA) was established as a non-profit organization for the purpose of keeping records related to the sport of harness racing, the participants, and the Standardbred breed of horse. USTA has created and maintains an online data base which includes data that is useful in a variety of settings for those interested in the sport, including ongoing updates regarding horse registrations, pedigree information, racing results and race entries.
The USTA owns all rights, title, and interest in the provided software including, not limited to the racing and breeding information, all source and output data, manuals, and other product of websites and services.
Usage of this site is under a nontransferable, non-exclusive and terminable license from a unique user ID and password which have been issued. You are responsible for maintaining the confidentiality of all Access Codes issued to you.
All USTA Data Base systems, programs, records, statistics, data, documentation, and any other material utilized or developed by USTA and the products and information supplied hereunder shall be and remain the sole property of USTA. All rights, title to, and interest in, including copyrights and renewals thereof, all systems, programming, records, statistics, data, documentation, operators’ manuals, components, and accessories comprising the system furnishing the services hereunder and provided by USTA shall remain the property of USTA. Materials utilized from the USTA systems should contain proper attribution and USTA copyright notices.
By accessing this system and utilizing the USTA Data Base, you agree with USTA’s determination that the USTA Data Base and the compilation of Information is confidential and proprietary to USTA and acknowledges that all or a portion of the database and compilation are copyrighted by USTA. Further, your usage of this site agrees that the USTA Data Base and the compilation of the Information gravely affects the effective and successful conduct of USTA’s business and that the failure to mark the USTA Data Base or Information as confidential or proprietary as set forth herein shall not affect its status as confidential or proprietary.

USTA is not liable to anyone else for any loss or injury caused by USTA’s negligence or any act or omission in receiving, storing, retransmitting, procuring, compiling, interpreting, reporting, delivering, or using any information or services.
The USTA Data Base or the Information is not guaranteed to be available at a time or location of your choosing or at any time. USTA shall not be liable for any loss or damage, delay in performance or nonperformance caused by equipment malfunction or breakdown, information unavailability, strikes or other labor disputes, or riots, fire, insurrection, war, failure of carriers, the elements, accidents, acts of God, or any other causes beyond USTA’s control whether or not similar to the foregoing.
Continued usage of this site by any account acknowledges all published fees will be due and payable by the account holder. USTA reserves the right, at any time, to change or increase the Fees or USTA’s billing methods, including adding fees or separate charges.
You may terminate this Agreement upon written notice to USTA if any change is unacceptable, which will also terminate your login and access to the USTA Database and Information. Use of this site and the USTA Data Base after notice of a change in the Fees constitutes acceptance of such change.
